(a) the Protection Work Notice dated 21 December 2023 containing 'clear examples of works that the [Respondent] and/or Owner should have known were not protection works';[10]
(b) the Respondent preparing an expert report dated 21 March 2024 on behalf of the Owner that was filed by the Owner in this proceeding, and that by preparing such a report for the Owner the Respondent placed himself in a 'position of direct conflict of interest';
(c) the proceeding being listed for a hearing before the BAB on 13 June 2024, and that on 11 June 2024 the Owner advised the BAB and the parties that the application for a building permit had been withdrawn and the appointment of the Respondent as RBS had been terminated;[12]
(d) a directions hearing being held on 16 July 2024 as a result of the withdrawal of the building permit application, at which hearing orders were made requiring the Respondent to file with the BAB any notification given pursuant to s 81(2) of the Act, and whereby the proceeding was listed for a hearing to determine the question that was the subject of the Preliminary Determination dated 14 February 2025 (Question);[13]
(e) the Applicant's solicitor writing to the Respondent on 5 September 2024 proposing consent orders quashing the Respondent's determination dated 19 January 2024 made pursuant to s 87 of the Act (Determination), and reserving costs;[14]
(f) The Respondent and the Owner resisting the quashing of the Determination, causing the Applicant to incur further costs in respect of the hearing of the Question;[15]
(g) The Question being determined in the Applicant's favour, and subsequently the Determination being quashed.[16]
(a) there was no determination of the appeal on its merits. Rather, the Determination was quashed because the subject matter of the dispute had 'fallen away', because the building permit application had been withdrawn;[20]
(b) when the protection work notice was issued, the Respondent was 'justifiably...of the view that the Protection Works... were appropriate in all of the circumstances';[21]
(c) the Respondent's conduct does not give rise to any inference that he acted in a manner 'which could be construed as being vexatious, obdurate and/or unreasonable';[22]
(d) the Applicant has not provided any basis to suggest that the Respondent acted inappropriately or that the report he prepared is 'tainted by bias';[23]
(e) disagreement with consent orders does not necessarily give rise to an entitlement to costs, and the 'debate between the parties' essentially centred around whether any further orders should be made and/or whether the continued debate about academic matters was necessary in the circumstances'. The Respondent submits further that the Question that came before the BAB was 'academic' as the subject matter of the dispute had fallen away.[24]
