Taking on board the number of non-conforming uses in that section of Malvern Road and the unlikely scenario that those uses will convert to traditional residential density uses, the Panel finds that a rezoning is warranted. The Panel's view is that the intended zone should allow existing commercial uses to redevelop and residential properties to redevelop at a higher density in keeping with their main road location.
When approved, the plan will be endorsed and will then form part of the permit. Waste collection from the development must be in accordance with the plan, to the satisfaction of the Responsible Authority.
The Responsible Authority may extend the periods referred to if a request is made in writing before the permit expires or within three months afterwards.
