RECOMMENDATIONS - CLAIM NOT SUITABLE FOR ASSESSMENT
s 81(1) denying liability for the claim. This was based on the fact that the claim was served outside of six months from the date of accident and the explanation for delay provided by the claimant was neither full nor satisfactory. This matter will be ventilated in Court. 11. The claimant submits the claim is not suitable for assessment in the Personal Injury Commission (Commission) pursuant to s 92 of the MAC Act. 12. The basis of unsuitability submitted by the claimant pursuant to the rule 99(3) of the Personal Injury Commission Rules 2021 (Rules). The regulations prescribe grounds to be considered when determining whether a matter is suitable or not. 13. The insurer also seeks the matter be exempted on the basis that the CTP claim and the other related claims should be heard together, given the claims involve the same incident and will involve the same evidence and witnesses. 14. The insurer relies on the following subsections:
(a) r 99(3)(a) Complex legal and factual issues, and
(b) r 99(3)(d) Proceedings involve non-CTP party.
(a) whether the claim involves complex legal or factual issues, or complex issues in the assessment of the amount of the claim;
(b) whether the claim involves issues of liability, including contributory negligence, fault or causation;
(c) whether a claimant or witness, considered by the Commission to be a material witness, resides outside the state;
(d) whether a claimant or insurer seeks to proceed against one or more non-CTP parties, and
(e) whether the insurer alleges that a person has made a false or misleading statement in a material particular in relation to the injuries, loss or damage sustained by the claimant in the accident giving rise to the claim.
Having reviewed the submissions and information before me, I consider that this matter involves a complexity envisaged by r 99(3) in which a claim may be found unsuitable for assessment. This matter it involves the following issues:
(a) complex legal or factual issues, or complex issues in the assessment of the amount of the claim;
(b) the claim involves issues of liability, including contributory negligence fault or causation, and
(c) parties are seeking to proceed against non-CTP parties and f proceedings in the District Court have commenced.
