FEDERAL CIRCUIT AND FAMILY COURT OF AUSTRALIA (DIVISION 1)
Note: The form of the order is subject to the entry in the Court's records.
Note: This copy of the Court's Reasons for judgment may be subject to review to remedy minor typographical or grammatical errors (r 10.14(b) Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Cth)), or to record a variation to the order pursuant to r 10.13 Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Cth).
Part XIVB of the Family Law Act 1975 (Cth) makes it an offence, except in very limited circumstances, to publish an account of proceedings that identify persons, associated persons, or witnesses involved in family law proceedings.
IT IS NOTED that publication of this judgment by this Court under the pseudonym Burke & Morgan has been approved pursuant to subsection 114Q(2) of the Family Law Act 1975 (Cth).
... that it would be appropriate and procedurally fair, to provide the parties with a further opportunity to file any additional evidence that they may wish to rely upon and for them to have an opportunity to articulate further submissions as to sanction and what orders ought to be made in light of these reasons. There may be evidence which the mother is concerned to place before the court to support submissions as to penalty, and in circumstances where I have found that the contraventions have occurred without a reasonable excuse, it is necessary and proper that the mother be afforded that opportunity (Galvis & Galvis [2024] FedCFamC1A 123).
(a) an issue arises in the proceedings about whether a person (the respondent) has contravened a child‑related order; and
(b) a party to the proceedings makes an application for an order under this Subdivision in relation to the issue.
(a) supporting compliance with child‑related orders; and
(b) resolving difficulties associated with child‑related orders that are parenting orders which have contributed to non‑compliance with such orders (including by varying or making further orders); and
(c) deterring non‑compliance with child‑related orders; and
(d) upholding the authority of the court by enforcing compliance with child‑related orders where the court considers this necessary and appropriate; and
(e) providing for sanctions for a person who contravenes a child‑related order without reasonable excuse.
...
- I respectfully leave it to the Court to determine what sanction, if any, is appropriate in the circumstances. I am committed to continuing to work towards rebuilding my relationship with [X and Y] [the children] through the family therapy process and the time we spend together and, building upon the steps [Ms Burke] [the mother] has taken since the June 2025 hearing for which I am thankful, have a sense of optimism that [Ms Burke] [the mother] and I will be able to co-parent them into the fine young boys and men they deserve to be.
9.1 Given the pending Final Hearing, the increased and constructive communication between the parents, and the Mother's improved insight and professional support network, there is little risk of any further contraventions.
9.2. In these circumstances, the Mother respectfully submits that the Court should exercise its discretion to find that no sanction is necessary, as the measures she has already implemented will continue to provide the most effective protections for the children's wellbeing and care.
(Emphasis added)
Even when the Children are reluctant to spend time with [Mr Morgan] [the father], I encourage them to spend time with their father, remind them that their father loves them and that they will have a great time.
(a) Pastoral counselling and support (the mother's affidavit at [15]);
(b) Engaging a treating psychologist at G Health Centre (the mother's affidavit at [17]); and
(c) The completion of a parenting course titled 'Up to Parents' (the mother's affidavit at [21]).
(a) This is a discrete issue relating only to the contravention proceedings (which will conclude after I deliver these reasons for judgment);
(b) The father has sought that his costs be paid as agreed, or as assessed, which is a modification of his previous orders sought as to costs;
(c) I accept, as was submitted on behalf of the father, that a costs application deferred until the final hearing, may be "lost" in the midst of the other issues to be determined at that time; and
(d) The parties have been on notice from at least 23 July 2025 (when I made orders to that effect) that costs remained an outstanding issue and each party has had an opportunity to file evidence as to the issue of costs.
(a) the financial circumstances of each party to the proceedings;
(b) whether any party to the proceedings is receiving assistance by way of legal aid in respect of the proceedings and, if so, the terms of the grant of the assistance to that party;
(c) the conduct of the parties to the proceedings in relation to the proceedings including, without limiting paragraphs (a) and (b), the conduct of the parties in relation to pleadings, particulars, discovery, inspection, directions to answer questions, admissions of facts, production of documents and similar matters, and in relation to their duty of disclosure under subsection 71B(1), 90RI(1) or 90YJA(1);
(d) whether the proceedings were necessitated by the failure of a party to the proceedings to comply with previous orders of the court;
(e) whether any party to the proceedings has been wholly unsuccessful in the proceedings;
(f) whether a party to the proceedings has made an offer in writing to the other party to the proceedings to settle the proceedings and the terms of any such offer;
(g) such other matters as the court considers relevant.
The necessity of the proceedings - s 114UB(3)(d)
... the mother does not take steps to arrange for the children to spend any time with the father. She acts to thwart the commencement of the period of time provided under the orders, on each occasion, and that prevention or disruption continues for the entire period of ordered time.
Whether a party has been wholly unsuccessful - s 114UB(3)(e)
