BSFW Investments Pty Ltd v Mildura RCC (Further Correction) [2017] VCAT 191
For Regional Building Consultant and William John Sutherland
Ms Carly Robertson of Counsel instructed by Best Hooper Lawyers. She called sworn lay evidence from Dr William Sutherland.
Development of the land for storage and animal treatment (2 sheds and paddocks) in association with the existing veterinary clinic
P1294/2016 - application under section 82 of the Planning and Environment Act 1987 to review the decision to grant a permit
P196/2016 - planning enforcement proceeding under Section 114 of the Planning and Environment Act 1987
Design and Development Overlay (DDO) Schedule 9.
Development Contributions Overlay Schedules 1, 2, and 3.
Clause 33.02-1: a permit is required to carry out at buildings and works on land zoned IZ3
Clause 43.02-2: a permit is required for 'buildings and works' pursuant to the DDO9
Clauses 11, 17.02, 21.02, 21.03, 21.07 and 21.08-4.
The subject land lies on the eastern side of Mildura and has an area of 2.023 hectares. It features a significant veterinary building at its front section. Whilst it is a matter of strong debate of the middle and rear sections have been used since the front section of the land had the clinic built, it is common ground that over this period this middle and rear section has featured a 'vine growing' aspect.
What extent of land gained the 'use' benefit of the 1988 Permit?
with these two points in my view corroborating the conclusion that the 1988 Permit endorsed plans were intended to show the whole of the subject land right through to the rear boundary as having the benefit of the 'use' approval authorised by that permit.
Since 1988, has there been any break in the use of the whole of the subject land for 'veterinary surgery and animal hospital' purposes for over two years?
More than one substantial use in the middle and rear areas?
TRIBUNALS FINDING ON CONDITION 2 OF THE 1988 PERMIT
Upon receipt of such plan, it shall be endorsed to form part of this permit issued. The endorsed plan shall not be altered or modified without the content of the Responsible Authority.
TRIBUNAL'S FINDINGS ON CONDITION 2 OF PLANNING PERMIT NO. 005.2010.00000358.01 DATED 25/11/10 AND CONDITION 3 OF PERMIT NO. 005.2010.00000411.001 DATED 21/04/2011
TRIBUNAL'S FINDING REGARDING FENCING AND DRAINAGE INFRASTRUCTURE OVER THE BALANCE AREA OF THE SUBJECT LAND
TRIBUNAL'S FINDING ON MERITS OF THE PROPOSED TWO SHEDS AND PADDOCKS
A three metre wide landscaping strip is proposed on the Subject Land along the common boundary between the Subject Land and the adjoining land to the south-west. This landscaping will assist to soften the appearance of the sheds when viewed from adjoining land. A permit condition will require the external cladding of the sheds to comply with the provisions of DDO9 which require the sheds to be muted and non-reflective.
I am unconvinced that approving the two proposed sheds and associated paddocks will either cause 'land use conflicts' and/or compromise these strategic aims in any significant way. The reality is that the whole of the subject land already enjoys 'use' rights for 'veterinary surgery and animal hospital' and these are relatively modest additional structures being proposed. As mentioned above, I see real weight to the submission that the construction of the two sheds will have the benefit of assisting with visually and acoustically separating the activities taking place on the subject land and the BSFW land.
