Bruno v Bruno [2023] SACAT 78
The applicant tenant sought internal review of an order of the Tribunal to terminate her tenancy. The respondent landlord initially made an application for vacant possession on the basis of the tenant's failure to pay rent for a period of approximately 10-12 years.
In the absence of a written residential tenancy agreement, the tenant had agreed to pay regular amounts into the respondent landlord's bank account to cover the mortgage payments in return for the right of occupancy. The Tribunal had to firstly determine whether this agreement constituted a residential tenancy agreement for the Tribunal to have jurisdiction to hear the dispute pursuant to of the (the RTA). The Tribunal had reference to the principles of contract law and the definition in of the RTA in making this determination.
The respondent landlord submitted that it was always his intention that this agreement constituted a tenancy agreement and that he would evict the tenant if she was in breach, despite their relationship as father and daughter. The applicant tenant made no submissions and the Tribunal proceeded to hear the matter in her absence, being satisfied that she was aware of the hearing and chose not to participate.
Held, granting leave and affirming the decision under review:
