Brewster v South Gippsland SC [2009] VCAT 2113
A permit may be granted to create smaller lots if any of the following apply:
Is the proposed subdivision one for which a planning permit may be granted?
Would the existing planning permit lawfully be able to be transferred to the proposed smaller lot, if created?
[1] Permit No. 2006/125. This permit is still current and will expire on 11 August 2011.
[3] Contained in the schedule to clause 52.03 of the planning scheme.
[4] There are a number of Tribunal and court decisions that address this issue, but this area of law is extremely complex and the application of relevant principles to this fact situation would be unclear.
