procedural. The Agreement was approved and will operate from 6 October 2023 with a nominal expiry date of 31 July 2027.
The Fair Work Commission approved an enterprise agreement for Boral's recycling operations in NSW and ACT. The agreement covers the Australian Workers' Union, which requested coverage as a bargaining representative. The Commission applied special transitional rules: because the agreement notification happened before 6 June 2023, the old genuine agreement rules applied; but because the agreement was actually made after 6 June 2023, the new better off overall test rules applied. The Commission was satisfied all legal requirements were met, confirmed that employees' minimum rights under the National Employment Standards are protected, and approved the agreement to start on 6 October 2023, running until 31 July 2027.
