The Applicant's cause of action arose at the earliest, as pleaded by it in paragraph 5 of its Statement of Claim, in 1986 when the allegedly illegal connection was made, alternatively, in 1987 as alleged in paragraph 1 of its Further and Better Particulars, alternatively at the latest by 1996 when damage occurred as set out in paragraph 6 of its Further and Better Particulars of its Statement of Claim when Mr Denham became aware of the cause of flooding."
4. In a facsimile transmission of the same date, the solicitors for the respondent asked for the matter to be listed so that it could seek orders that:
