(b) Conditions in the permit are amended by replacing the existing conditions with the conditions set out in Appendix A.
(c) Plans endorsed under the permit are amended and the responsible authority is directed to endorse amended plans that the responsible authority has approved pursuant to condition 1 of the amended permit.
Ms Nicola Collingwood, Barrister, instructed by Best Hooper Solicitors.
This is an application to amend Permit 5/2010/232/1, a permit for a large mixed use development by amending endorsed plans and permit conditions. The most controversial aspect of the proposed amendment is the proposal to increase the height of the highest portion of the existing building from 8 stories to 10 stories
Application under section 87A of the Planning and Environment Act 1987 for amendment of a permit
The subject land is located on the south side of Bay Road, midway between Bluff Road to the west and Reserve Road to the east in Sandringham. The land is within and on the western periphery of an area of strategic importance known as the Bayside Business Employment Area .The land is a combination of two lots with a frontage to Bay Road of 159 metres and an area of 2.35 hectares.
The Tribunal inspected the land and locality on 28 August 2010.

7.6 Bay Road South Side - Height (14m), Setback, Landscaping and Design Guidelines
Bay Road is the key road that provides access to the industrial area. Whilst it has a reasonable appearance at present (in parts), further opportunities exist to upgrade the appearance and landscape qualities of both the road reserve and of abutting properties.
Controls should be applied to all properties along the south side of Bay Road. Requirements should include a maximum building height (14 metres), a generous standard front setback for buildings (15 metres), the requirement for landscaping in the frontage and design guidelines for new buildings. The aim should be to provide high quality medium to low rise buildings in a strongly landscaped setting.
A 14m maximum building height has been identified at this time to respect the generally low rise nature of development throughout Bayside, whilst providing some incentive for redevelopment of former industrial sites.
Detailed urban design guidelines will need to be prepared to provide further guidance regarding the image and built form to occur throughout the area in the future.
We consider that the paragraph we have underlined is a relevant statement of the strategic purpose of the preferred height limit of 14 metres.
If VCAT allows this extension of floors, and roof, then the original VCAT decision has been overturned by an application based on inputs that the developer purposely caused (such as constructing an ugly building) to ensure the application meets the legislative requirements.
A Tribunal that allows this type of behaviour really loses its respect with the community as they become completely confused on the overall purpose of VCAT.
Nevertheless, it is our opinion that clause 22.04 is the most specific expression of local planning policy relevant to this land and that a balanced decision must seek to give effect to the policy.
In 2010 we did not view the College or its playing fields as a sensitive viewpoint and this remains our opinion.

[11] The applicant submitted that the Tribunal should give no weight to the Minister's submission submitting that the letter did not constitute an example of the Minister intervening in a hearing in accordance with the special powers afforded to him under the Act. Council did not resist this submission. In the event it was unnecessary for us to determine this question.
[12] There are 470 dwellings proposed on the subject land, there is a large four-storey apartment building nearing completion on the adjoining land to the west and a 4 to 6 story mixed-use development beyond that. There will ultimately be a significant residential population immediately approximate to these proposed licensed premises.
