The evidence as to how the Council came to its decision on the permit application and the Development Plan, including the decision as to notice, is contained in the Council's written submission, and in the "Planning Assessment Report" completed and signed by Mr O'Dwyer on 28 September 1999, a copy of which was tendered on behalf of the Applicant. This takes the form of a comprehensive checklist with respect to a permit application, which identifies the relevant controls, makes reference to any referrals that may be necessary, contains two options about the giving of notice, and then goes into the identification of relevant policies, requirements of the zone and any overlay, whether there are any relevant "particular provisions" or incorporated documents, and then turns to the officer's recommendation. The checklist does not contemplate that it will be used for approval of a Development Plan, although it contains reference to Overlay controls along with other regulatory provisions.
