- The applicant has lodged an appeal under s 8.7 of the Environmental Planning and Assessment Act 1979 (EPA Act) against the deemed refusal by the Council of the City of Sydney Local Planning Panel (LPP) of development application D/2023/727 (DA), lodged on 14 August 2023. The DA seeks consent for the demolition of existing buildings and construction of two new residential flat buildings with basement car parking across two parcels of land at 21C Billyard Avenue and 10 Onslow Avenue, Elizabeth Bay NSW (site). The Council of the City of Sydney (Council) is the respondent in this appeal by virtue of s 8.15(4) of the EPA Act.
