To date, three clear categories of cases have emerged where the Court has determined that it is appropriate to notionally add back to the pool of assets, that is, assets that no longer exist. They are:
(a) Where the parties have expended money on legal fees. In DJM v JLM [1998] FamCA 97; (1998) FLC 92-816 the Full Court said at 85,262:
(b) Where there has been a premature distribution of matrimonial assets. In Townsend v Townsend (1995) Nicholson CJ as he then was with whom Fogarty and Jordan JJ agreed, said at 81,654:
"In my view, what occurred in this case, as I said during the course of argument was, in fact, a premature distribution of a proportion of the matrimonial assets. What the husband did was to distribute to himself an asset in which the wife had a legitimate interest. In such circumstances I consider that it would be unjust in the extreme to simply treat such conduct by the husband as a matter to which regard should be had under section 75(2)..."
(c) In the circumstances outlined by Baker J in Kowaliw & Kowaliw [1981] FamCA 70; (1981) FLC 91-092 at 76,644:
"As a statement of general principle, I am firmly of the view that financial losses incurred by parties or either of them in the course of a marriage whether such losses result from a joint or several liability, should be shared by them (although not necessarily equally) except in the following circumstances:
(a) where one of the parties has embarked upon a course of conduct designed to reduce or minimise the effective value or worth of matrimonial assets, or
(b) where one of the parties has acted recklessly, negligently or wantonly with matrimonial assets, the overall effect of which has reduced or minimised their value.
Conduct of the kind referred to in para (a) and (b) above having economic consequences is clearly in my view relevant under s 75(2)(o) to applications for settlement of property instituted under the provisions of s 79."
(1) Horse 10 ($12,500)
(2) Horse 11 ($10,000)
(3) Horse 12 ($15,000)
(4) Horse 13 ($10,000)
(5) Horse 14 ($12,500)
(6) Horse 15 ($7,500)
(7) Horse 16 ($8,800)
(8) Horse 17 ($10,000)
(9) Horse 18 ($1,500)
(10) Horse 19 ($500)
(11) Horse 20 ($1,000)
(12) Horse 21 (Sold with foal for $4,500)
(13) Horse 21's foal
(14) Horse 22 ($1,500)
(15) Horse 23 ($3,000)
(16) Horse 24 ($1,500)
(17) Horse 25 ($5,000)
(18) Horse 26 ($1,500)
(19) Horse 27 ($1,500)
(20) Horse 28 ($2,200)
(21) Horse 29 (foal)
PROPERTY PURPORTEDLY BUT NOT ACTUALLY TRANSFERRED
(2) For the purposes of paragraph (1)(a), the court must consider the following matters:
(a) what arrangements would promote the safety (including safety from being subjected to, or exposed to, family violence, abuse, neglect, or other harm) of:
(i) the child; and
(ii) each person who has care of the child (whether or not a person has parental responsibility for the child);
(b) any views expressed by the child;
(c) the developmental, psychological, emotional and cultural needs of the child;
(d) the capacity of each person who has or is proposed to have parental responsibility for the child to provide for the child's developmental, psychological, emotional and cultural needs;
(e) the benefit to the child of being able to have a relationship with the child's parents, and other people who are significant to the child, where it is safe to do so;
(f) anything else that is relevant to the particular circumstances of the child.
Husband's time with the children since separation
"After all the love everyone in your family and friends here have given you, this is how you treat them? With a total lack of respect? What does that say about you and your values? [Mr R] and I are so sad and disappointed in you.....Once you do something that affects peoples trust in you, it is done. You can't get that back. You can work hard to recover it, but it's a difficult road."
I became concerned that if [Y] and [Z] spent time with [Mr Jaskolski] or his family prior to the family report interviews the girls would be exposed to the entirely inaccurate extremely negative view of me and my household which appeared to be inexplicably held by [X], [Mr Jaskolski] and the [Jaskolski] family.
I was of the view that until [X] and I had the opportunity to participate in family therapy and I understood why [X] had taken the position he had, I was unwilling to risk [Y] and [Z] leaving my care and being exposed to the parental conflict by [Mr Jaskolski] or the [Jaskolski] family. I was concerned that [Y] and [Z] may have been manipulated or coached prior to the family report had they spent time with [Mr Jaskolski] or his family on that occasion.[81]
I certify that the preceding two hundred and forty (240) numbered paragraphs are a true copy of the Reasons for Judgment of the Honourable Justice Gill.
