(1) The Association is an association incorporated under the AI Act;
(2) The proper rules of the Association as at 4 August 2025 are set out in the document titled 'Swan Unit Western Australian State Emergency Service Incorporated Constitution August 2017 v2.1';
(3) Immediately prior to the meeting on 4 August 2025 Mr Jeater was an ordinary member of the Association within the meaning of rule 8;
(4) A Committee meeting was held at the premises of the Association commencing on 4 August 2025 with a duration of about 1 hour and 20 minutes. This meeting was quorate and with the consent of Mr Jeater it was recorded (Exhibit 2 and Exhibit 3).
(5) At the meeting Mr Jeater spoke the words: '[t]herefore I rescind my membership from the Swan State Emergency Service. Thank you very much for your time' (the words).
(6) At 9.40 am on 7 August 2025 the Committee emailed Mr Jeater (copied to Ms Welch) requesting him to confirm his resignation and at 2.22 pm on 7 August 2025 Ms Welch replied by email (copied to Mr Jeater) to say:[2]
Good Afternoon Mr Miles
Thank you for the inclusion in emails, as Mr Jeaters' Advocate. On behalf of Mr Jeater I would like to request a complete and full copy of the recording of the meeting in its entirety that was recorded as part of the proceedings - be supplied to Mr Jeater on USB as I suspect it will be a large file and not easily emailed. If that could be picked up either by myself; or posted by registered post to Mr Jeater it would be appreciated (including confirmation of which method will be taken).
In answer to your question, to clarify, Mr Jeater rescinded his membership of the Swan State Emergency Service on Monday evening during the meeting.
Kind Regards
Di Welch
(1) The Rules provide that a member may only resign from the Association by giving notice in writing to the Committee - which he has not done;
(2) Even if the Rules permit a member to resign from the Association by speaking words to the Committee, that when he spoke at the 4 August 2025 meeting:
(3) Whatever the requirements as to resignation by a member under the Rules are and whatever the circumstances were in which he spoke the words, a resignation will only become effective when it is formally accepted by the Committee - which it has not done.
(1) The Rules permit a member to resign from the Association by the member giving notice to the Committee of their decision to resign but they do not require that the notice be in writing, with the result that oral notice of resignation to the Committee is an effective resignation;
(2) A notice of resignation has immediate effect unless the notice states it is to take effect only on a certain date or after a certain period of time;
(3) The words spoken by Mr Jeater clearly manifested his decision to cease being a member of the Association with immediate effect;
(4) If there was any doubt about the meaning of Mr Jeater's words (which the Association denies), then this doubt was removed when Ms Welch (who copied Mr Jeater to her email) confirmed that Mr Jeater had resigned from the Association at the 4 August 2025 meeting; and
(5) It denies that the Committee engaged in any coercive conduct either at or before the 4 August 2025 meeting.
(1) Do the rules of the Association permit a member to give notice of resignation only in writing?
(2) Do the Rules provide that a resignation of a member will only have effect upon the Committee resolving to accept the resignation?
(3) Was Mr Jeater's resignation from the Association procured by coercive conduct on the part of the Committee?
(4) Did Mr Jeater at the 4 August 2025 meeting speak words to the Committee which clearly manifested his decision to immediately cease being a member of the Association?
The principles for the proper construction of the rules of an association
The principles relevant to resignation from an association
A member shall cease to be a member of Swan SES:
15.2 If the member resigns from membership of Swan SES by giving notice thereof;
15.3 If the member is expelled by the Committee pursuant to clause 17 herein; or
15.4 If membership is revoked by the Local Manager by reason of absence for a period of two (2) consecutive calendar months without contact with the unit.
The relevant principles on resignation from an association
Is a member required to give notice in writing to the Association of their decision to resign from the Association?
...
17.1 Written notice of the proposal to expel the member(s) shall be served upon the member(s) not less than fourteen (14) days prior to a meeting of the Committee at which the proposal for expulsion is to be considered. The written notice shall contain particulars of the alleged detrimental conduct.'
...
17.4 In the event of the Committee resolving to expel the member, the member shall be given written notice of the Committee's resolution and shall cease to be a member of the Swan SES fourteen (14) days after confirmation of the committee's resolution has been served on the member.
...
A casual vacancy occurs in the Committee if the Committee Member, including a permanent Office bearer:
...
23.2 Resigns their position by giving notice in writing delivered to the Local Manager or the Deputy Local Manager
...
At least thirty (30) days' notice of any Annual General Meeting shall be given to members. The notice shall set out where and when the meeting will be held and the nature and order of the business to be transacted at the meeting.
...
Notice may be given to members by serving it on a member personally, sending it by post, email, text message/electronic page to the contact details appearing in the register of members. When a notice is sent by these methods, sending of the notice shall be deemed to be properly issued if the notice is sufficiently addressed to the member of intention.
Do the Rules provide that a resignation of a member will only have effect upon the Association accepting the resignation?
Was Mr Jeater's resignation procured by coercive conduct on the part of the Committee?
... the management committee's conduct has created a hostile environment and exposed the applicant to psychosocial hazards contrary to the Work Health and Safety Act 2020 (WA). This includes intimidation, procedural irregularities, and misuse of disciplinary powers in a manner that threatens not only governance integrity but the applicant's psychological health and safety.
Did Mr Jeater at the 4 August 2025 meeting say words which clearly manifested his decision to immediately cease being a member of the Association?
rescind
...
verb (t) 1. to abrogate; annul, revoke; repeal.
2. to invalidate (an act, measure, etc.) by a later action or a higher authority.
[Latin rescindere cut off, annul]
-rescindable, adjective
-rescinder, noun
verb (i) 1. (sometimes followed by from) to give up an office or position.
2. to submit; yield.
-verb (t) 3. to give up (an office, position, etc.) formally.
4. to relinquish, as a right or claim.
5. to submit (oneself, one's mind, etc.) without resistance.
6. to hand or sign over; surrender, as to the care or control of another: to resign a child to foster-parents.
-phrase 7. resign oneself to, to come reluctantly to an acceptance of.
[Middle English resignen, from Old French resigner, from Latin resignāre unseal, annul]
(1) The Committee acted professionally during the meeting and displayed appropriate courtesy to Mr Jeater;
(2) The Committee provided Mr Jeater every opportunity to explain his position to them (which he did for about an hour) and it also gave him opportunities to take breaks during the meeting;
(3) Mr Jeater had Ms Welch to support him throughout the meeting;
(4) The Committee did not prompt Mr Jeater to resign; and
(5) The recordings of the meeting (Exhibit 2 and Exhibit 3) do not support Mr Jeater's contention that when he spoke the words that he was 'choking up' and 'in tears', although his voice did tremble thereby showing that this was indeed an emotionally significant time for him.
(1) Mr Jeater's words were spoken voluntarily and were unambiguous, that is, they clearly manifested his intention to immediately resign from the Association; and
(2) While Mr Jeater did become emotionally affected towards the end of the meeting he was not overcome to the point where the words he spoke could not be understood as manifesting his decision to resign.
I certify that the preceding paragraph(s) comprise the reasons for decision of the State Administrative Tribunal.
[1] It is clear that Mr Jeater's belief that Ms Welch could act as a mediator at the meeting was a genuine belief based on a poorly drafted rule: rule 17.3.
