Mr P
Original judgment source is linked above.
The list of requirements which the council planning officer has prepared has no legal status. The only way they can be required to be included in a development plan is by further amendment of the planning scheme by way of introduction of a schedule, which includes them as requirements.[3]
Your Council should consult with the landowner on the form of the final control for the site, which would then be subject to the normal amendment process including a full public exhibition. This exhibition of an amendment should occur without delay and within one year of the date of this letter.
A development plan is required to ensure that any proposal for the development of the subject land considers the development of the site as a whole, including the reuse of the significant building contained on the Victorian Heritage Register, and not only the development of vacant land forming part of the site.
The proposed amendment will facilitate the future orderly planning and sensitive redevelopment of the site contained on the Victorian Heritage Register, allowing for a range of redevelopment opportunities which:
Three copies of an amended plan of subdivision must be submitted to the Responsible Authority, and when approved by the Responsible Authority shall be the endorsed plan and form part of this permit. The plan must be generally in accordance with the amended plan submitted with the application, but must be amended to the satisfaction of the Responsible Authority to show:
(a) all buildings on proposed lot 16 at single storey height only;
(b) building envelope for lot 13 to be double story and set back a minimum of 4.5 metres from Watchtower Rise and High Street road frontages; or a medium density double storey building envelope for lots 9-13 with a minimum 4.5m setback to all boundaries;
