Overview
- For some 20 years, the appellant, Ms Bauer, along with her husband (Mr Kress) and mother have been living in a caravan on site 25 at the respondent's residential community park on the north coast of New South Wales.
- Ms Bauer appeals from orders made by the Tribunal on 8 September 2021 that terminated an agreement in respect of the caravan site, requiring her to give possession to the respondent on 9 September 2021 and suspended this order for possession until 10 December 2021.
- These orders were founded upon provisions in the Residential (Land Lease) Communities Act 2013 (NSW) (the RLLC) and upon a finding by the Tribunal that Ms Bauer, as "home owner" (a term defined in this Act) had seriously and persistently breached the site agreement.
- For the reasons set out below, we have decided that her appeal should be dismissed.
