1. Compensation be paid in the sum of $778,766.88 for loss that the applicant suffered because of the contravention.
2. The Applicant file and serve any Affidavit material and written submissions on the issue of costs by no later than 4:00pm on 27 April 2026.
3. The Respondent file and serve any Affidavit material and written submissions on the issue of costs by no later than 4:00pm on 25 May 2026.
4. The application be adjourned to 11 June 2026 at 10:00am for hearing on the issue of costs (with an estimated hearing time of half (½) a day) in the Federal Circuit and Family Court of Australia sitting at Brisbane.

1. On 5 March 2026, I delivered a judgment where I calculated the total economic loss at $599,354.06. Because there needed to be some compensation for the fact that the applicant would have to pay tax on that lump sum (which would not have been paid to the same extent if earned during those financial years), I asked counsel for submissions on the amount that should be given.

1. The parties have agreed that there should be an extra $44,576.94 in compensation for the extra tax that would be paid. I accept those calculations.
2. The past economic loss component of the compensation was calculated (by me in the previous judgment) at $490,012.06. The past out of pocket expenses were $2,300 and for psychiatric consultations, the past sum was $1,500. This total sum of $493,812.06 attracted interest at 4% above the RBA cash rate.
3. This sum totalled $159,071.75.
4. However, to accommodate the fact that the amount was incurred over the whole period between 28 July 2021 and 31 March 2026, that sum should be divided in half. This gives a total interest amount of $79,535.88.

1. In accordance with the earlier judgment, the total amount of compensation awarded under s 545(2)(b) of the Fair Work Act 2009 (Cth) is as follows:

Agreed sum for past and future economic loss allowing for tax - $643,931.00

Past out-of-pocket expenses - $ 2,300.00

Past cost of psychiatrist consultations - $ 1,500.00

Interest on past economic loss sums - $ 79,535.88

Future out of pocket expenses - $ 1,500.00

General damages - $ 50,000.00

1. The parties have made applications for costs. I will make orders for written submissions on the issue and then decide the question "on the papers".
