(a) Whether there should be a restraint on the mother changing X's residence without first providing not less than 60 days prior written notice or whether there is simply a requirement to provide notice (Order 1.5.3 and 1.5.4);
(b) Whether the live with and time with orders should be made limited to "while the father resides in the USA" (Orders 4 and 5);
(c) The time X shall spend with the father during the school holidays (Order 5.4.1. and 5.4.2);
(d) Whether if the father is present in Australia, he also spends time with X from Good Friday until Easter Monday (Order 6.2.4);
(e) Whether the father should be required to pay a deposit bond if X travels overseas (Order 9.2);
(f) Whether the mother should deliver to the father the expired Country J passport (Order 13); and
(g) Whether the mother should be required to provide notice to the father of health issues that render her unable to care for X, the timing of the notice, updates as to capacity and alternate care arrangements made for X (Orders 33 and 34).
(a) what arrangements would promote the safety (including safety from being subjected to, or exposed to, family violence, abuse, neglect, or other harm) of:
(i) the child; and
(ii) each person who has care of the child (whether or not a person has parental responsibility for the child);
(b) any views expressed by the child;
(c) the developmental, psychological, emotional and cultural needs of the child;
(d) the capacity of each person who has or is proposed to have parental responsibility for the child to provide for the child's developmental, psychological, emotional and cultural needs;
(e) the benefit to the child of being able to have a relationship with the child's parents, and other people who are significant to the child, where it is safe to do so;
(f) anything else that is relevant to the particular circumstances of the child.
Whether there should be a restraint on the mother changing X's residence without first providing not less than 60 days prior written notice or whether there is simply a requirement to provide notice (Order 1.5.3 and 1.5.4)
Whether the live with and time with orders should be made limited to "while the father resides in the USA" (Orders 4 and 5)
The time X shall spend with the father during the school holidays (Order 5.4.1. and 5.4.2)
Whether if the father is present in Australia he also spends time with X from Good Friday until Easter Monday (Order 6.2.4)
Whether the father should be required to pay a deposit bond if X travels overseas (Order 9.2);
The next matter is obviously the degree of risk that the departing parent, once permitted to leave Australia, will, despite assurances to the contrary, choose not to return. In assessing that degree of risk, obvious considerations are the existence (or otherwise) of continuing ties between the departing parent and Australia (such as the ownership of real estate, the existence of business interests, or the residence of close family or friends here), the existence and strength of possible motives not to return (including the level of conflict between the parents, particularly over child related issues) and the existence and strength of possible motives to remain in the other nominated country (such as the ownership of real estate, the existence of business interests, or the residence of close family and/or personal friends there).
Whether the mother should deliver to the father the expired Country J passport (Order 13);
Whether the mother should be required to provide notice to the father of health issues that render her unable to care for X, the timing of the notice, updates as to capacity and alternate care arrangements made for X (Order 33 and 34)
