- In this proceeding, the plaintiff, Bacchus Corp Pty Ltd ("Bacchus"), sues the defendant, Grapes of Australia Management Limited ("GAML"), for damages for breach of contract. Bacchus alleges that GAML repudiated the agreement between them, and that Bacchus accepted that repudiation, in July 1999. The case was opened on the basis that Bacchus' damages were $177,404. GAML counterclaimed for damages for misleading and deceptive conduct by Bacchus and for unjust enrichment. The quantum of the counterclaim was said to be $75,942.14, being the sum previously paid by GAML to Bacchus pursuant to a statutory demand.
