1 The applicant, Vasilije (Bill) Grahovac, commenced employment with the respondent or its corporate predecessor on 28 May 1974 and was summarily dismissed on 16 March 2009.
2 The respondent's decision to dismiss the applicant was made in circumstances where, following exhaustive internal investigation, it was satisfied that the applicant had sexually harassed a fellow employee who by agreement between the parties, will be referred to by the pseudonym TD. For his part the applicant, who is more than twice TD's age, vigorously denies the allegation that he sexually harassed TD and for her part TD maintains that her version of events is truthful and accurate. Apart from the applicant and TD, there were no other witnesses to the events of 4 March 2009, the day on which the harassment allegedly occurred.
3 Failing successful conciliation on 20 March 2009, the matter proceeded to hearing as an unfair dismissal application on 23 April 2009, 24 April 2009 and 1 May 2009. The applicant was the sole witness in his own case and the Company, in addition to photographs and other documentary material relied upon, called evidence from the following persons:
