FEDERAL CIRCUIT AND FAMILY COURT OF AUSTRALIA (DIVISION 1)
Note: The form of the order is subject to the entry in the Court's records.
Note: This copy of the Court's Reasons for judgment may be subject to review to remedy minor typographical or grammatical errors (r 10.14(b) Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Cth)), or to record a variation to the order pursuant to r 10.13 Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Cth).
Part XIVB of the Family Law Act 1975 (Cth) makes it an offence, except in very limited circumstances, to publish an account of proceedings that identify persons, associated persons, or witnesses involved in family law proceedings.
IT IS NOTED that publication of this judgment by this Court under a pseudonym Aveskamp & Nosek has been approved pursuant to subsection 114Q(2) of the Family Law Act 1975 (Cth).
(a) it would be unfair to permit this course given that aspects of the orders sought to be advanced on behalf of the father, if leave is granted to amend the Response, are very different such that contentions would now need to be put to him when he is called to give evidence and raised with other witnesses, including the author of the two Family Reports made available for the Court's assistance in the proceedings; and
(b) it was unfair to the mother to permit such a change at the time in the proceedings in which it occurs; and
(c) it is not proper; and
(d) prejudice is accorded to the mother's case because there would be an impost on Counsel in terms of the cross-examination to be undertaken of the father and those witnesses yet to be called.
(a) this Court is not bound, in the orders it makes, by the proposals advanced on behalf of parents or on behalf of the Independent Children's Lawyer; and
(b) subject to the requirement to afford, to the parties who appear before it, procedural fairness, by way of knowing that the Court is contemplating an order of a particular type, it may, in the exercise of discretion, make those orders which it considers proper.
I certify that the preceding fourteen (14) numbered paragraphs are a true copy of the Ex Tempore Reasons for Judgment of the Honourable Justice Hogan.
