Do shift limits apply to the rostering process or to actual time worked?
Employees who are unable to complete their rostered shift because of an emergency must be relieved from duty and signed off after a maximum period of sixteen (16) hours. In these circumstances, emergency means a major equipment failure or operational emergency or other emergency due to fire, flood, storm, earthquake, explosion, accident, derailment, epidemic or warlike action. The working of extended hours in this circumstance is subject to the crews' indications of their fitness to continue.
There were no replacement crew coaches available at this time. It takes up to 24 hours for a replacement crew coach to arrive in Cook, due to the remote location of Cook. There is no safe location to stable the train for this duration.
Without a functioning crew coach, Pacific National cannot operate a service with more than two locomotive drivers as crew because there is no safe location for the third locomotive driver to travel passenger.
Service 4MP5 did not depart Adelaide until 4:35pm on 22 June 2023 due to:
(a) an evacuation drill which occurred at the Adelaide Freight Terminal at 2:35pm on 22 June 2023 for a period of 25 minutes; and
(b) locomotive 'NR92' being moved from the lead unit to a secondary unit because, prior to the service's scheduled departure, 'NR92' was observed to have a water leak.
[1] Section 557A has subsequently been amended.
