- The Applicant's argument does not contest the proposition that an advertising structure is not a "permissible" purpose of development within Zone No 6(a) in terms of the LEP. However, it submits that the Council has "the onus of establishing that the proposed development is prohibited" and that "the Applicant is prohibited from making its development application" seeking consent to the erection of the proposed advertising structure.
