Judgment (38 paragraphs)
- The Applicant opposes the Council's Motion which was originally filed on 2 March 2000 ie some 28 days beyond the prescribed statutory period.
- The extension of time sought is to enable the Council to file instanter a Notice of Motion in the form set forth in the annexure hereto, instituting the appeal.
- In Australand Holdings Pty Ltd v Hornsby Council (Unreported 17 June 1998) Lloyd J has helpfully collected the relevant principles by reference to established authority. In particular, his Honour identified the following as the "main factors" to inform the Court's exercise of discretion - (i.) length of delay; (ii.) reason for delay; (iii.) extent of prejudice (iv.) whether there is an arguable case.
