- For the reasons provided in this decision, I have decided to set aside the decision of the responsible authority and direct that a permit be granted subject to conditions.
In permit application 469/2008/P a permit is granted and directed to be issued for the land at 211-212 Nepean Highway, Seaford. The permit will allow development of the land for 19 dwellings and create access to a road in a Road Zone Category 1 in accordance with endorsed plans and subject to the following conditions.
- Before the development starts, amended plans to the satisfaction of the Responsible Authority must be submitted to be approved by the Responsible Authority. When approved, the plans will be endorsed and will then form part of the permit. The plans must be drawn to scale with dimensions and three copies must be provided. The plans must be generally in accordance with the plans prepared by Warren J Foster Architects plan numbers TP06, TP07a, TP08a, TP09, TP10a-TP13a (inclusive), TP14 - TP17 (inclusive) all dated August 2010 and substituted by the Victorian Civil and Administrative Tribunal but modified to show:
