[1] This is a reference by the Registrar pursuant to r 982 of the Uniform Civil Procedure Rules and Practice Direction 4/2002 Case - Flow Management - Civil Jurisdiction. This Practice Direction concerns the implementation of a system to facilitate the philosophy of the Uniform Civil Procedure Rules as set out in r 5, that is, to facilitate the just and expeditious resolution of the real issues in civil proceedings at a minimum of expense. The court may impose appropriate sanctions if a party does not comply with the rules to achieve these ends.
[2] The system sets timelines by which proceedings should progress to specific stages. By para 4.3 of the Practice Direction, where a request for trial date has not been filed 180 days after the final date of filing notices of intention to defend Registrar may call on the plaintiff by notice to show cause why the proceeding should not be deemed resolved.
