mixed. Interim order issued: (1) Applicant to lodge amended plans by 25 June 2012 modifying western setbacks to ensure east-facing apartments at 2A Montrose Place maintain current sunlight levels; (2)...
A developer wanted to build a ten-storey apartment building in Hawthorn East, near Auburn railway station. The local council refused the permit, mainly because of concerns about overshadowing neighbouring apartments. The Tribunal found that while the building's height was acceptable under planning policy for higher density development near transport, the design needed to change to protect sunlight for the neighbouring building's east-facing balconies. Rather than refusing the permit outright, the Tribunal gave the developer a chance to amend the plans to fix the sunlight problem. The Tribunal also said that standard suburban rules about building separation (Clause 55) don't apply in areas designated for high-density development, but that doesn't mean neighbours should lose all their sunlight—the 'Guidelines for Higher Density Residential Development' require fair sharing of development opportunities.

[15] In summary, we accept that it is appropriate that we place a modest degree of weight on the ACS document, in exercising our discretion. In particular, the ACS document provides some assistance at least in terms of highlighting some of the key design issues that arise in this type of proposal and provides one approach to how to deal with them.
a. the ACS has not even got to the Ministerial authorisation stage; and
b. hence we do not know how it might be received by a panel, or for that matter the Planning Minister.
The development will have an unreasonable impact on the amenity of the dwellings at 2A Montrose Place, Hawthorn East and the dwelling at 2 Lilydale Grove, Hawthorn East by way of visual bulk, reduced solar access and acoustic privacy.

Objective 2.5: To ensure building separation supports private amenity and reinforces neighbourhood character.
