- COMMISSIONER: This is an appeal pursuant to the provisions of s 97 of the Environmental Planning and Assessment Act 1979 (EPA Act) against the refusal of Development Application No. D/2014/231 for alterations and additions to the upper two levels of an existing mixed use building (the proposal) at 40 Macleay Street, Potts Point (the site) by the Council of the City of Sydney (the Council).
