Introduction
- Mr Argyropoulos has applied for review of a decision of the respondent Roads and Maritime Services (RMS) made on 9 September 2016 to refuse his application made under s 40B of the Passenger Transport Act 1990 (the PT Act) for a private hire vehicle driver authority. That decision, affirmed on internal review, a decision made on 18 August 2016 to refuse the application, which was made on 10 August 2016. The original decision was that the RMS could not attest that Mr Argyropoulos was a fit and proper person to be the driver of a private hire vehicle. The decision on internal review agreed with the reasons for the original decision, and concluded that the applicant was not a fit and proper person to hold a private hire vehicle driver authority, or possess sufficient responsibility and aptitude to drive public passenger vehicles.
- For the reasons which follow, the decision under review is affirmed.
