(#P44_4086) The appellant is a company in which Ms Lindsey is the sole director. After this decision was reserved Ms McDonald sent a submission attacking Mr Lindsey for saying at the appeal hearing that he was a director of the company. That submission has no relevance to the outcome of the appeal because Mr Lindsey gave no evidence before the Commissioner and his statement cannot reflect adversely on the evidence of Ms Lindsey.
