FEDERAL CIRCUIT AND FAMILY COURT OF AUSTRALIA (DIVISION 1)

(b) The Applicant mother's application to adjourn the commencement of the final hearing to 5 February 2026;
(c) The Respondent father's application for leave to rely upon the affidavits of each Ms HH filed on 23 November 2023 and Ms AM filed on 23 November 2023 at the final hearing;

(e) The Respondent father's application for leave to amend the final orders sought by him as set out in his Further Amended Response filed on 19 December 2025.
Note: The form of the order is subject to the entry in the Court's records.
Note: This copy of the Court's Reasons for judgment may be subject to review to remedy minor typographical or grammatical errors (r 10.14(b) Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Cth)), or to record a variation to the order pursuant to r 10.13 Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Cth).
Part XIVB of the Family Law Act 1975 (Cth) makes it an offence, except in very limited circumstances, to publish an account of proceedings that identify persons, associated persons, or witnesses involved in family law proceedings.
IT IS NOTED that publication of this judgment by this Court under the pseudonym Kennedy & Peyton has been approved pursuant to subsection 114Q(2) of the Family Law Act 1975 (Cth).
(a) The Applicant mother's applications:
(i) for leave to issue subpoenas to the children's treating therapists to produce documents and give evidence at the final hearing; and
(ii) to adjourn the commencement of the final hearing to 5 February 2026 (what would have been day four of the trial listing);
(b) The Respondent father's applications for leave to:
(i) rely upon the affidavits of each Ms HH filed on 23 November 2023 and Ms AM filed on 23 November 2023 at the final hearing;
(ii) issue a subpoena to Mr AB to produce documents and give evidence at the final hearing; and
(iii) to amend the final orders sought by him as set out in his Further Amended Response filed on 19 December 2025.
- The nature, position, number and differing ages of the fractures were considered by CPS to be inconsistent with accidental or inadvertent injury. The implication, as will be discussed, is that a more plausible explanation is that the injuries sustained by [D] were deliberate.
(a) Rejecting the possible explanations for D's injuries given by the father that included the child Y dropping something on D, the father's "overzealous" "play activity" with D or a sibling "jumping or tripping and falling" on D (at [213]-[218]);
(b) The father's reluctant admission that D's injuries could only have occurred whilst in his care, the care of his mother or less likely the care of D's maternal grandparents (at [145]);
(c) A finding that D's injuries had been "deliberately inflicted... over a period between May and September 2020" (at [271]); and
(d) A finding that either the father or D's mother were responsible for D's injuries (at [276]).
...
I found it extremely difficult to consider the possibility that [D] was deliberately harmed by anyone, I thought that there must have been an accident and that [D] may have an underlying medical condition that made him prone to bone breakage.
...
- It subsequently occurred to me that I may have injured [D] when hugging him and the other two children at the same time, which is something I did on occasions. I made enquiries with respect to that possibility and the nature of [D's] [...] injuries. I have now come to accept that there is a significant possibility that [D] was deliberately harmed.

21. Liberty is granted to each of the parties to:
Approach the Judicial Registrar responsible for the management of the court file to vary the obligations under these orders to ensure readiness for trial.
To relist the matter at short notice in relation to trial directions or any application for leave for subpoena to issue.
(Emphasis in the original)
(1) An affidavit must:
(a) be divided into consecutively numbered paragraphs, with each paragraph being, as far as possible, confined to a distinct part of the subject matter; and
(b) state, at the beginning of the first page:
(i) the file number of the proceeding for which the affidavit is sworn (or affirmed); and
(ii) the full name of the party on whose behalf the affidavit is filed;
(iii) the full name of the deponent;
(iv) the full residential address of the deponent, unless disclosing this address would compromise the deponent's safety; and
(c) have a statement at the end specifying:
(i) the name of the witness before whom the affidavit is sworn (or affirmed) and signed; and
(ii) the date when, and the place where, the affidavit is sworn (or affirmed) and signed; and
(d) bear the name of the person who prepared the affidavit.
Note 1: An affidavit must also comply with the requirements for documents in rule 2.14.
Note 2: A professional witness may provide a business address in place of a residential address.
(a) the deponent of an affidavit is a party; and
(b) the affidavit does not disclose the deponent's address; and

the deponent's address must be provided to the court by email and the address must not be disclosed other than in accordance with an order of the court.
EVENTS ON THE FIRST DAY OF TRIAL & THE ORAL APPLICATIONS
(a) Counsel's agreement that there would be no objections to "affidavit evidence (including documents in the two (2) tender books which have been provided to the Court. Counsel submits that submissions can be made as to the weight to be attributed to evidence".
(b) Counsel's view "that the ten (10) days set aside for the trial will not be needed and it may be possible to conclude the trial by 10.2.2025 and perhaps earlier".
(c) Counsel's agreement that it would "not be necessary to call [Ms U]", who had previously prepared Family Reports in the current and the earlier tranche of proceedings, and whose most recent report prepared 28 February 2024 was filed and annexed to an affidavit of the mother's solicitor filed 29 January 2026.
(d) A trial plan that proposed the court sit on Monday, Tuesday, Wednesday and Thursday of the first week of the scheduled trial listing, and on Tuesday of the second week of the trial listing. Notably, that proposed trial plan did not make any allowance for closing submissions and nor was any explanation given to for the proposed disjointed sitting days.
(e) A random reference was made in the document that "there may be some limited additional oral evidence sought to be led... [by] lay witnesses".
(f) A joint chronology was otherwise annexed.
(a) There is "an irreparable element of unfair prejudice in unnecessarily delaying proceedings" (per French CJ at [5]);
(b) Inefficiencies in the use of court resources arising from the adjournment or vacation of trials upon not only the parties to the present proceedings but other court users (per French CJ at [5] and [30] and Gummow, Jayne, Crennan, Kiefel and Bell JJ at [112]‑[113]);
(c) The lack of a satisfactory explanation ought be taken into account (per French CJ at [5] and [30] and per Gummow, Jayne, Crennan, Kiefel and Bell JJ at [102]-[103]).
(a) Ms AM who had earlier filed an affidavit on 23 November 2023; and
(b) Ms HH who had earlier filed an affidavit on 23 November 2023.
I certify that the preceding fifty-six (56) numbered paragraphs are a true copy of the Reasons for Judgment of the Honourable Justice Kari.
