Judgment
- COMMISSIONER: These are two appeals pursuant to the provisions of s 8.7(1) of the Environmental Planning and Assessment Act 1979 (EPA Act) against the refusal of two development applications, at 40-76 William Street, Leichhardt (the site), by the Inner West Council (the Council), as follows:
- Development Application No DA/2021/0437 (File No 2021/228923) for the Stage 1 Concept Plan for the adaptive reuse of an existing industrial warehouse development and conversion to a residential flat building development to accommodate 181 apartments over 2 levels of basement parking (the Stage 1 concept proposal).
- Development Application No DA/2020/0501 and SECPP No PPSEC-72 (File No 2021/73128) for alterations and additions to an existing industrial warehouse development and conversion to a residential flat building development to accommodate 181 apartments over two levels of basement parking (the Stage 2 development proposal).
- The appeals were subject to conciliation on 15 November 2021, in accordance with the provisions of s 34 of the Land and Environment Court Act 1979 (LEC Act). As agreement was not reached, the conciliation conference was terminated, pursuant to s 34(4) of the LEC Act.
- The applications were last amended on 7 November 2023 (Exhibits X, Y and Z). The amendment of the applications was unopposed and granted by the Court.
