Anderson v Stonnington CC [2018] VCAT 102
Anthony Southall QC and John Atkins of counsel (on 8-9 February 2017).
Jason Pizer QC of counsel (on 29 November 2017), instructed by Simon Nixon and associates, solicitors
John Rantino of Maddocks lawyers, assisted by Gareth Gale, Council officer
Application for declarations under ss 149A and/or 149B of the Planning and Environment Act 1987.
The declarations relate generally to the issue of whether works authorised under building permits prior to the introduction of a Heritage Overlay can lawfully continue without a planning permit being obtained under that overlay.
The land at 21 William Street, South Yarra is an irregular shaped residential lot with a street frontage of approximately 15.3 m, and an average depth of approximately 44.6 m. The rear of the land backs onto 'Lovers Walk', adjacent to the Frankston-Cranbourne railway line.
The land contains an Italianate villa dating from the 1890s. A large part of the residence has been demolished, and the residence has been substantially rebuilt and/or renovated.
An 'exemption' from a planning permit requirement, or an actual 'right' to develop under the planning scheme?
