(a) The 2020 Report stated that trees 396 to 428 existed at the time of the report and they included six River Red Gums.
(b) The consortium's various draft versions of the DP did not include the tree reserve but indicated some vegetation in the area of the tree reserve should be protected (see figure 11).
(c) In August 2023, the Council told the consortium that its draft DP must be amended in various ways, one of which was inclusion of the tree reserve.
(d) On or around November 2023, the applicant said it removed all trees from the tree reserve (including trees 420 to 426, including two River Red Gums) and various trees outside the tree reserve (including four River Red Gums being trees 403, 404, 407 & 409) following advice from its arborist consultants (being the firm that authored the 2020 Report) that no permission was required under the planning scheme to remove the trees because the trees were exempt 'planted' vegetation under the Vegetation Protection Overlay (VPO) and clause 52.17.[37]
(e) The consortium included all the Council's amendments in its final version of the DP dated February 2024, other than inclusion of the tree reserve.
(f) In March 2024, the Council said it first became aware of the tree removal.
(g) On 6 May 2024, the Council reiterated its request from August 2023 that the DP must show the tree reserve.
(h) On 20 May 2024, the consortium's lawyers told the Council of the reasons the consortium opposed inclusion of the tree reserve in the DP. The consortium's lawyers then referred to the tree reserve on adjoining land that the applicant owned at 815 & 821 Bridge Inn Road (lots 43 & 44 in the DP). To persuade the Council to not include the tree reserve on the land, the lawyers wrote:
We are instructed that our client has expanded tree reserves within the Development Plan in order to address Council's concerns in relation to this matter. This includes an increase in the size of the tree reserve for trees [455] and 425.[38]
(i) The Council's officers in their report to the Council dated 16 July 2024 recommended amending the draft DP to include the tree reserve before it was approved and with a note that it would be revegetated. The Council accepted this advice and the Council included this amendment in the DP.
(j) On 3 October 2024, the Council told the applicant its removal of trees on or around November 2023 was a contravention of the planning scheme.
(k) On 29 October 2024, the applicant gave the Council a copy of its arborist's report dated 12 October 2023 in support of its contention that the removal was no contravention.
(l) On 31 October 2024, the Council told the applicant that it would take no further action regarding the removal of trees 420 to 425 in the tree reserve but would take enforcement action regarding the removal of the four River Red Gums outside the tree reserve.
(m) The applicant then decided to seek retrospective permission to remove the four River Red Gums outside the tree reserve and that application is expected to be shortly lodged.
[1] The submissions and evidence of the parties, the documents relied on the parties that were filed with the Tribunal and the filed statements of grounds have all been considered in the determination of the proceeding. In accordance with the practice of the Tribunal, not all of this material will be cited or referred to in these reasons.
[4] The consortium comprised the owners of 811, 815, 821, 875 & 881 Bridge Inn Road, 945 Yan Yean Road, 214 & 220 Cookes Road. It will be observed that two of these lots are lots owned by applicants in this proceeding. 220 Cookes Road is owned by Mr Galileos, a respondent in Application P875/2024.

[24] The applicant's proposed plan of subdivision includes a strip two metres wide as road widening along Cookes Road and a three metres wide 'paper road' between the lots and the tree reserve, primarily to provide pedestrian access to the lots. The Council opposed these measures for reasons that are unnecessary to refer to.
[25] Planning scheme cl 53.01 schedule, provision for Precinct 2A under the MSP.
[26] Although the Precinct Plan (figure 6) shows this land for residential development at 'low density' the applicants do not oppose the different form of residential development in the DP.
[27] Another River Red Gum (tree 700) is outside the tree reserve and is to be retained.

[37] The arborist's assessment of these trees had therefore changed between 2020 and 2023.
[38] The reference to these trees is unclear, but the intent was to increase the area of the tree reserve on nearby land at 815 & 821 Bridge Inn Road in exchange for not including the tree reserve on the land. The applicant states the nearby tree reserve had an area of 0.196 hectares in its early version of the DP but this was increased to 0.286 hectares in the final version in 2024.

[42] It should be added that the consortium did not oppose the drainage reserve adjoining the tree reserve as the consortium included it in the final draft version of the DP.
