133 There was, however, a very significant issue raised at trial by the defendant over whether or not the defendant had ever received the plaintiff's invoices in respect of each of the first four progress payments, ie, including the deposit invoice. These invoices were all admitted into evidence at trial - see exhibit TB(A), page 2, as to the stage 1 deposit amount of $AUD593,500, dated 8 October 2003, addressed to the defendant at its correct Singapore address of 2 Maritime Square, #03-03 SPI Building, Singapore, 099255. The plaintiff's second invoice for stage 2, in the amount of $AUD890,250, dated 15 October 2003, was addressed to the same Singapore address and bearing the stamp 'faxed', exhibit TB(A), page 4 (Interim Stage Certificate also dated 15 October 2003, at page 3). The plaintiff's third invoice is to be found at exhibit TB(A), page 6, dated 28 October 2003, in the amount of $AUD1,780,500, also addressed to the same Singapore address (Interim Stage Certificate at exhibit TB(A), page 5, also dated 28 October 2003). The plaintiff's fourth invoice, in the amount of $AUD1,483,750, dated 5 March 2004, was addressed to the same Singapore address and is to be found at exhibit TB(A), page 12. I will presently deal with the issue raised by the defendant concerning alleged non-receipt of all the plaintiff's four invoices.
