6 February 2026 in Sydney with the applicant attending by audio visual link (MS Teams). Mr Phillip Perry of counsel appeared for the applicant instructed by Ms Joanne Nehme, legal practitioner. Mr Josh Beran of counsel appeared for the second respondent instructed by Ms Lily Fung, legal practitioner. Mr Vincent was also present. 2. It was agreed during conciliation that a finding would be made that the first respondent did not hold a valid New South Wales workers compensation policy at the time of the injury. 3. During conciliation the second respondent's Application to Lodge Additional Documents dated 3 February 2026 was admitted into evidence. 4. It was also agreed that when the matter is remitted to the President for referral to a Medical Assessor to assess the applicant's injuries there will be a notation included that the right shoulder impairment has been agreed between the parties at 8% WPI. 5. I am satisfied the parties to the dispute understand the nature of the application and the legal implications of any assertion made in the information supplied. I have used my best endeavours in attempting to bring the parties to the dispute to a settlement acceptable to all of them. I am satisfied the parties have had sufficient opportunity to explore settlement and that they have been unable to reach an agreed resolution of the dispute.
