Introduction
- The OSP55665 costs application is pursuant to s 60(2) of the NCAT Act on the basis of the existence of special circumstances within s 60(3)(c) and (g). The determination of this application may involve answering the following three questions: 1. whether the Tribunal has power to make a costs order against the applicants; 2. if so, whether there are special circumstances warranting an award of costs in favour of OSP55665; 3. if so, whether the discretion should be exercised to award costs.
- Before dealing with this issue, it is appropriate to set out the applicable provisions of the NCAT Act and the relevant legal and other principles, and to summarise the submissions of the parties.
