- By development application dated 28 August 2001, the Harrow Trust applied to the City of Burnside ("the Council") for provisional development plan consent for a development described in that application as a "supported residential facility". Upon receipt, the Council classified the proposal as a Category 3 development within the meaning of of the , and gave the public and other notices required by the provisions of that section. As a consequence, it received eight representations, one objecting to the proposal and seven in support. Having considered the application and the representations received, the Council resolved, on 6 November 2001, to grant provisional development plan consent, subject to one condition. The Adelaide Hebrew Congregation Incorporated, which had made a representation to the Council opposing the proposed development, was aggrieved by the Council's decision and appealed to this Court against it.
