FEDERAL CIRCUIT AND FAMILY COURT OF AUSTRALIA (DIVISION 1)
Note: The form of the order is subject to the entry in the Court's records.
Note: This copy of the Court's Reasons for judgment may be subject to review to remedy minor typographical or grammatical errors (r 10.14(b) Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Cth)), or to record a variation to the order pursuant to r 10.13 Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Cth).
Part XIVB of the Family Law Act 1975 (Cth) makes it an offence, except in very limited circumstances, to publish an account of proceedings that identify persons, associated persons, or witnesses involved in family law proceedings.
IT IS NOTED that publication of this judgment by this Court under a pseudonym has been approved pursuant to subsection 114Q(2) of the Family Law Act 1975 (Cth). In addition to the use of pseudonyms for the parties, other changes have been made to the published judgment to protect the identity of a party or a witness. Such changes (other than when a letter is used instead of a name or an address) are apparent on the face of the judgment by the use of square brackets
... [the children's] behaviour is a direct result and a reflection of the traumatic impact of the prolonged parental conflict and parenting dispute, and the multiple abrupt changes in parenting arrangements.
In my opinion, to avoid further harm being experienced by the children, it is imperative that a final decision about the parenting arrangement be made as soon as possible. In my opinion, there is no likely prospect of a co-parenting arrangement being successful, and therefore, the children should live with one of their parents and have no contact with the other.
(a) In relation to the trial last year, although there were hundreds of recordings referred to by the parents, only three audio and one video recording were tendered into evidence in circumstances where both parents were privately legally represented;
(b) The recordings and the transcripts for the three audio recordings (which are relatively short) were made available to both parents' lawyers on 7 July 2025, and in the previous proceedings the transcripts were accepted as accurate;
(c) The mother has made additional recordings in December 2024 and January 2025, and the ICL intends to tender one of those recordings for which her office has prepared a transcript, also provided to both parents;
(d) The ICL submits that the Department of Families, Seniors, Disability and Child Safety have had ongoing involvement in this matter since the trial last year and she has issued a subpoena or hopes to issue a subpoena for a representative to attend at the trial to indicate what, if any, intentions they have to further intervene in the future with the family;
(e) At this stage, the Court continues to have jurisdiction as no orders have been made in any child protection proceedings;
(f) The ICL informed the Court that she is currently liaising with two further potential witnesses: Ms GG, the director of the Early Learning Centre attended by Y, and Ms HH, the guidance officer at X's current school, to ensure that the Court has available current evidence about the children for the trial;
(g) If the trial is adjourned, the ICL concedes that a further Family Report may be necessary, but submitted she would have grave concerns about the children's further involvement in that process which could be regarded as system's abuse;
(h) Both parents are highly intelligent and should be able to adequately assist their legal representatives in preparation for the trial and the ICL confirmed her willingness to continue to provide assistance to the lawyers now acting in their preparation for the trial; and
(i) If the adjournment is granted, the father's legal representatives may be able to appear just for the purpose of cross-examination of the mother.
I certify that the preceding twenty-six (26) numbered paragraphs are a true copy of the Ex Tempore Reasons for Judgment of the Honourable Justice Carew.
