- These proceedings commenced on 8 July 1998 on the application of the plaintiff for an injunction which was granted on the same day. As at that date a number of accounts in relation to the Transferred Lines were unpaid and overdue. These were as follows:
- In my opinion, the plaintiff had no claim for damages for breach of contract in respect of the services relating to these accounts being the services in respect of the Transferred Lines. Even if the defendant disconnected the services concerned, I hold that it was entitled to do so at the time, being before the commencement of this action and before the issue and service of the injunction. Thus, at the commencement of this action the defendant was not in breach of any contract with the plaintiff in relation to the Transferred Lines.
