### sec.13 Disability or mental illness To remove any doubt, it is declared that a person with a disability or mental illness— may be eligible under section 10 (1) (a) ; but is not eligible under section 10 (1) (a) only because the person has the disability or mental illness. In this section— eligible means eligible for access to voluntary assisted dying. mental illness see the Mental Health Act 2016 , section 10 .
