### sec.150C When a person has committed an offence
This section applies for working out, for the following provisions, whether a person has committed an offence against a provision of an Act—
section 91ZHA ;
section 150B ;
a provision of a regulation prescribed by regulation to be a provision to which this section applies.
A person has committed an offence if the person—
has been convicted of the offence; or
has been served with an infringement notice for the offence and the infringement notice has been dealt with under the State Penalties Enforcement Act 1999 .
For subsection (2) (b) , an infringement notice for an offence served on a person has been dealt with under the State Penalties Enforcement Act 1999 if 1 of the following has happened under that Act—
the fine for the infringement notice has been paid in full;
the person has applied for approval to pay the fine for the infringement notice by instalments;
an enforcement order has been made against the person for the offence under section 38 of that Act.

(sec.150C-ssec.1) This section applies for working out, for the following provisions, whether a person has committed an offence against a provision of an Act— section 91ZHA ; section 150B ; a provision of a regulation prescribed by regulation to be a provision to which this section applies.
(sec.150C-ssec.2) A person has committed an offence if the person— has been convicted of the offence; or has been served with an infringement notice for the offence and the infringement notice has been dealt with under the State Penalties Enforcement Act 1999 .
(sec.150C-ssec.3) For subsection (2) (b) , an infringement notice for an offence served on a person has been dealt with under the State Penalties Enforcement Act 1999 if 1 of the following has happened under that Act— the fine for the infringement notice has been paid in full; the person has applied for approval to pay the fine for the infringement notice by instalments; an enforcement order has been made against the person for the offence under section 38 of that Act.
- (a) section 91ZHA ;
- (b) section 150B ;
- (c) a provision of a regulation prescribed by regulation to be a provision to which this section applies.
- (a) has been convicted of the offence; or
- (b) has been served with an infringement notice for the offence and the infringement notice has been dealt with under the State Penalties Enforcement Act 1999 .
- (a) the fine for the infringement notice has been paid in full;
