### sec.335AE Giving accreditation
The chief executive must promptly consider an application for accreditation and give, or refuse to give, the accreditation.
The chief executive must accredit an applicant as the busway manager for a busway if satisfied—
the applicant has the competency and capacity to manage the busway safely; and
the applicant has an appropriate safety management system; and
the applicant has the financial capacity or public risk insurance arrangements to meet reasonable potential accident liabilities for the busway; and
the applicant has rights of access to all land the applicant needs for the establishment and operation of the busway; and
the applicant has rights to the use of all busway transport infrastructure and other infrastructure the applicant needs for the establishment and operation of the busway.
In considering a safety management system, the chief executive must consider—
what the applicant proposes for the busway; and
the appropriateness of the safety management system for what the applicant proposes; and
the safety levels achievable, consistent with the nature of what the applicant proposes, at a reasonable cost; and
the need for efficient and competitive busway transport services; and
consistency with generally accepted risk management principles; and
the levels of safety proposed compared with the levels of safety of competing transport modes.
Subsection (3) does not limit what the chief executive may consider in considering a safety management system.
If the chief executive decides to give the accreditation, the chief executive must promptly give the applicant a written notice stating—
the decision; and
the details of the accreditation, including its scope; and
if the accreditation is given on conditions—
the details of the conditions; and
the reason for the conditions.
If the chief executive decides not give the accreditation, the chief executive must promptly give the applicant a written notice stating—
the decision; and
the reason for the decision.
A written notice given under subsection (5) or (6) must be accompanied by an information notice for the decision the subject of the notice.
