### sec.33 Prohibition on road works etc. on State-controlled roads
A person must not, without lawful excuse or the written approval of the chief executive—
carry out road works on a State-controlled road; or
interfere with a State-controlled road or its operation.
Maximum penalty—200 penalty units.
A person may apply to the chief executive for an approval mentioned in subsection (1) .

An approval may be subject to conditions decided by the chief executive.
A person must not contravene a condition that applies to the person under subsection (3) .

Subsection (1) does not apply to a person who carries out maintenance of ancillary works and encroachments or landscaping that does not interfere with a State-controlled road or its operation.
An approval under subsection (1) for road works that are road access works may only be given if there is a permitted road access location under a decision in force under section 62 (1) in relation to the road access works.
