19 Authorised people
(1) The road transport authority may appoint a person to be an authorised
person for the road transport legislation.
Note 1 For the making of appointments (including acting appointments), see the
Legislation Act, pt 19.3.
Note 2 In particular, a person may be appointed for a particular provision of a
law (see Legislation Act, s 7 (3)) and an appointment may be made by
naming a person or nominating the occupant of a position (see s 207).
(2) A regulation may prescribe a person to be an authorised person for
the road transport legislation or a provision of the road transport
Administration Division 2.5
(3) A person must not be appointed under subsection (1) unless—
(a) the person is an Australian citizen or a permanent resident of
Australia; and
(b) the road transport authority is satisfied that the person is a
suitable person to be authorised, having regard in particular to—
(i) whether the person has any criminal convictions; and
(ii) the person’s employment record; and
(c) the person has satisfactorily completed adequate training to
exercise the powers of an authorised person proposed to be
given to the person.
(4) However, this section does not authorise the road transport authority
to appoint a person to be an authorised person for part 3 (Infringement
notices for certain offences).
