### sec.123 Restrictions—inspection of health records
If an inspector has entered a place, without a warrant, where persons are irradiated during a diagnostic or therapeutic procedure, the inspector may not—
inspect records at the place recording the health history or diagnoses of a patient of a health practitioner made in the course of the practitioner’s practice ( health records ); or
photograph or film, take extracts from, or copy, the records.
However, if an inspector has entered the place with the occupier’s consent under section 112 and the occupier has also consented, in the approved form, to the inspector inspecting health records or types of health records at the place, the inspector may—
inspect the records or types of records; or
photograph or film, take extracts from, or copy, the records or types of records.
