### sec.40 Chair and deputy chair of council
The Minister may appoint—
a member of the council to be chair of the council; and
another member to be deputy chair of the council.
A member may be appointed as the chair or deputy chair at the same time as the person is appointed as a member.
A vacancy arises in the office of chair or deputy chair if the person holding the office—
resigns office by signed notice of resignation given to the Minister; or
ceases to be a member; or
is suspended by the Minister under section 41 (3) .
A person resigning the office of chair or deputy chair may continue to be a member.
The deputy chair is to act as chair—
during a vacancy in the office of the chair; and
during all periods when the chair is absent from duty or for another reason can not perform the duties of the office.

(sec.40-ssec.1) The Minister may appoint— a member of the council to be chair of the council; and another member to be deputy chair of the council.

- (a) a member of the council to be chair of the council; and
- (b) another member to be deputy chair of the council.
- (a) resigns office by signed notice of resignation given to the Minister; or
- (b) ceases to be a member; or
- (c) is suspended by the Minister under section 41 (3) .
- (a) during a vacancy in the office of the chair; and
- (b) during all periods when the chair is absent from duty or for another reason can not perform the duties of the office.
