### sec.41 Vacancy in office of member
The office of a member of the council becomes vacant if the member—
completes a term of office; or
resigns office by signed notice to the Minister giving at least 1 month’s notice; or
is removed from office by the Minister under subsection (2) ; or
is suspended by the Minister under subsection (3) .
The Minister may remove a member from office if the Minister is satisfied the member—
has been guilty of misconduct; or
is incapable of performing the member’s duties; or
has neglected his or her duties or performed them incompetently; or
has been absent without permission of the chair from 3 consecutive meetings of which due notice was given.
The Minister may suspend a member for up to 60 days by signed notice to the member if—
there is an allegation of misconduct against the member; or
the Minister is satisfied a matter has arisen in relation to the member that may be grounds for removal under this section.
