### sec.58 Initial appointment of acting chief executive officer For the purpose of appointing a person to act in the office of chief executive officer with effect from the commencement, section 40 applies with the modifications provided under subsections (2) and (3). For section 40(1)(a), the office of chief executive officer is taken to be vacant from the commencement. Section 40(4) does not apply to the extent the Minister could not recommend a person for appointment only because the Minister has not consulted the board about the appointment of the person under section 33(3).
