### sec.19 Discrimination by industrial, professional, trade or business organisation in pre-membership area
An organisation of workers, employers, or people who carry on an industry, profession, trade or business must not discriminate—
in failing to accept a person’s application for membership of the organisation; or
in the arrangements made for deciding who may join; or
in deciding who may join; or
in the terms on which a person may join.
Subsection (1) does not apply to discrimination on the basis of trade union activity if the Industrial Relations Act 2016 , chapter 12 , part 9 , division 2 or part 10 applies.

(sec.19-ssec.1) An organisation of workers, employers, or people who carry on an industry, profession, trade or business must not discriminate— in failing to accept a person’s application for membership of the organisation; or in the arrangements made for deciding who may join; or in deciding who may join; or in the terms on which a person may join.
(sec.19-ssec.2) Subsection (1) does not apply to discrimination on the basis of trade union activity if the Industrial Relations Act 2016 , chapter 12 , part 9 , division 2 or part 10 applies.
- (a) in failing to accept a person’s application for membership of the organisation; or
- (b) in the arrangements made for deciding who may join; or
- (c) in deciding who may join; or
- (d) in the terms on which a person may join.
